Welcome to Q-AI ("we", "us", "our"). By using our online photo editing services through social communication channels such as WhatsApp, Telegram, and Signal ("Services"), you agree to these Terms and Conditions. Please read these terms carefully before using our services.

• User: Anyone who uses our services.
• Services: The online photo editing features offered by Q-AI.
• Social communication channels: Digital platforms through which users can send images to Q-AI for editing via chat apps.
• Processing: The automatic or manual adjustment of uploaded images by our technology.

2. Applicability

These terms apply to all users of our services. By using our services, you agree to be bound by these terms. If you do not agree to these terms, you should not use our services.

3. Use of the services

• You must be 18 years or older to use our services or have permission from a legal representative.
• You guarantee that the images you have uploaded do not infringe on copyrights, privacy rights, or other legal rights of third parties.
• We reserve the right to refuse or remove material if it violates these terms or legislation.
• We reserve the right to suspend or terminate user accounts if there is abuse of the services.

4. Intellectual property rights and indemnification

• You retain the ownership rights to the images you upload.
• By uploading images, you grant us a temporary, non-exclusive license to process and return them.
• You indemnify Q-AI from all claims, costs, or legal actions resulting from copyright infringements or other legal violations by the content you uploaded.

5. Content and user responsibility

• The user is fully responsible for uploading, processing, and sharing images via our services. If an image contains other people, the user declares that he/she has obtained the necessary consent from the individuals involved before the image is uploaded. Q-AI is not liable for any claims arising from unlawful use of images by users.
• The user acknowledges and agrees that the processing and sharing of images featuring others may be subject to privacy legislation. Q-AI provides no legal guarantees and is not liable for any violations of applicable privacy laws by the user.
• Q-AI accepts no liability for claims or legal actions from third parties regarding the unlawful use of photos by users.
• The user indemnifies Q-AI against any claim, demand, or legal action arising from the processing of images without the required consent from third parties.

6. Data protection and privacy

Your privacy is important to us. We process your personal data in accordance with our privacy statement and our cookie policy. Q-AI only uses a functional session cookie to manage your session securely. This cookie is necessary for the proper functioning of our website and application and is automatically deleted as soon as you close your browser or the application.

Uploaded images are used solely for editing purposes and are kept as long as necessary for the provision of the service. Images are automatically and irretrievably deleted after 2 weeks. Q-AI does not use marketing cookies and does not share your data with third parties.

7. Liability

• We offer our services "as is" and make no guarantees regarding availability, accuracy, or suitability for a specific purpose.
• We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability is limited to the amount you have paid for the services in the past three months (if applicable).
• This limitation of liability does not apply in cases of intent or gross negligence.

8. Jurisdiction and applicable law

• These conditions are governed by Dutch law.
• Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law prescribes otherwise.

9. Changes to these terms

We reserve the right to change these terms at any time. We will communicate changes via our website or other communication channels. Continued use of our services after changes to the terms means that you accept them.
